Submissions to the IBM VM Download Library are voluntary and intended to assist the VM community. IBM welcomes constructive contributions.

Your submission of software (source, object, or other program code) or documents (collectively called "Content") constitutes your acceptance of the following terms and conditions. However, IBM reserves sole discretion in deciding whether to accept any submission or delete a previously accepted submission.

IBM is not obligated to edit or review Content or verify the accuracy or reliability of Content.

IBM is not obligated to protect Content from loss or damage during uploading into the Library, storage in the Library or downloading from the Library.

You shall not provide any Content that contains any harmful program code or "viruses". You shall not provide any Content that is considered inappropriate, offensive or disrespectful based on business and social standards.

Your Content will not be considered confidential and will be accessible by others inside and outside of IBM.

You grant to IBM a worldwide, royalty-free, nonexclusive and irrevocable license to use, execute, reproduce, display and distribute your Content and sublicense others to do the same. You also grant to IBM a worldwide, royalty-free, nonexclusive and irrevocable license to make derivative works of your Content for its internal use and likewise sublicense others to make derivative works of your Content for their internal use. You warrant that you have the authority to grant the foregoing licenses, free of claims by any party. You also warrant the accuracy of information you provide in the Certificate of Originality.

IBM is not liable to you for any wrongful or unauthorized use of the Content by any third party.

IBM will attempt to include any copyright notice provided with your Content in copies distributed by IBM; however, IBM will not be liable for omissions.

Nothing in this Agreement prevents the copyright owner from distributing the Content or derivative works thereof by means other than the Library or charging others for the Content or derivative works thereof distributed by such means.

The copyright owner may withdraw Content from the Library at any time.

IBM in its sole discretion may decide to discontinue the Library at any time and to delete its contents.

This Agreement will be governed by the laws of the State of New York, USA.
