Agreement for Downloading from the IBM VM Download Library

Your access to the Library constitutes acceptance of the following terms and conditions. However, IBM reserves the right and sole discretion to deny or discontinue access to the Library to anyone or to discontinue the Library altogether at any time.

IBM grants you a worldwide, royalty-free, nonexclusive license to download, use, execute, reproduce, display and distribute Library contents subject to the following conditions:

  • You must preserve any copyright notice in the Library contents which you download and include such notice in any copies that you make or distribute.

  • You may not decompile or disassemble any object code programs downloaded from the Library.

  • You may not charge for any Library contents that were contributed by others.

IBM also grants you a worldwide, royalty-free, nonexclusive license to make derivative works of Library contents for your internal use only. You may not distribute to any third party a derivative work of any Library contents that were contributed by others.

IBM or the copyright owner may withdraw content from the Library at any time.

Nothing in this Agreement prevents the copyright owner from distributing the content or derivative works thereof by means other than the Library or charging others for the content or derivative works thereof distributed by such means.

IBM provides the Library contents on an "AS IS" basis. IBM might not have reviewed the Library contents.

IBM MAKES NO WARRANTIES, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE CONCERNING THE LIBRARY.

IBM IS NOT LIABLE FOR ANY DIRECT OR INDIRECT DAMAGES, INCLUDING WITHOUT LIMITATION, LOST PROFITS, LOST SAVINGS, OR ANY INCIDENTAL, SPECIAL, OR INDIRECT DAMAGES OR OTHER ECONOMIC OR CONSEQUENTIAL DAMAGES, EVEN IF IBM IS INFORMED OF THEIR POSSIBILITY. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS AND EXCLUSION MAY NOT APPLY TO YOU.

You are responsible for making selections from the Library, appropriateness and reliability of Library contents and the manner and effectiveness of the downloading process.

This Agreement will be governed by the laws of the State of New York, USA.
